Headcanon ≠ Canon.
As of this date, Kyle has NOT been confirmed to have any mental illness in canon. It is purely headcanon. And it is FINE to headcanon that!
The problem comes when you force that headcanon down the throats of everyone else. Because not everyone will like the headcanon, or maybe they don’t understand it. And that’s ALSO fine! NO ONE should be forced to conform with any headcanon.
In addition, being mentally ill DOES NOT excuse you or your sh!tty actions. Do we excuse serial killers because they are mentally ill? Of course not. Mental illness provides a REASON for a certain behavior, but not an EXCUSE.
There are, of course, exceptions to this. This can be evident in modern criminal justice systems.
For example, in the USA, when faced with criminal charges, there is the Insanity Defense. I linked the Wikipedia article here, but the short definition, per FindLaw, states:
“A criminal defendant who is found to have been legally insane when he or
she committed a crime may be found not guilty by reason of insanity. In
some cases, the defendant may be found guilty but sentenced to a less
severe punishment due to a mental impairment. In states that allow the
insanity defense, defendants must prove to the court that they did not
understand what they were doing; failed to know right from wrong; acted
on an uncontrollable impulse or some variety of these factors”.There are several things to unpack here.
First, note that this defense does not always work. In fact, the success rate of the Insanity Defense in the USA, per the Wikipedia article I linked above, is only 26%.
Second, a person may be found guilty, but due to their mental illness, will be sentenced to a less severe punishment. The Court recognizes the mental illness, but still finds YOU responsible. In this case, mental illness may be the reason for the act, but NOT the excuse.
And finally, the conditions under which the Insanity Defense is found acceptable are limited. As stated above, the defendant MUST show one or more of three conditions: 1) inability to understand what they were doing, 2) cannot tell right from wrong, and/or 3) uncontrollable impulse.
From THIS DEFINITION ALONE, Kyle fits NONE of these conditions. He CLEARLY knows right from wrong (the light vs. the dark side). He CLEARLY understands what he is doing (he knew he was killing Han, he knew he would have killed Leia, he knew he was going to kill Luke, etc.). And he CLEARLY has the ability to CONTROL his actions (this is especially evident when he kills S/noke). Therefore, in a USA court of law, Kyle would not be able to successfully use the Insanity Defense.
